my wife started work at 05:00 and finished at 14:00. all she had was a bacon sandwich at her work station

Not only are you allowed a break, the employer are legally obliged to provide a rest period

In California the company is mandated to provide a 30 minute meal break: ========== California Labor Code 512 (a): An employer may not employ an employee for a work period of more than five hours per day without providing the employee with a meal period of not less than 30 minutes, except that if the total work period per day of the employee is no more than six hours, the meal period may be waived by mutual consent of both the employer and employee. ==========

In the UK its 5 minutes break for every hour worked. So usually employers group these 5 minutes together to form a lunch break. So for example if 4 hours are worked then a break of 20minutes would be taken at some point. However this rule is broken by so many companies. Ive worked for loads which break these rules.

yes you are allowed a break or should I say you should be allowed a break..I work a 8 hour shift and I get a 1 hour lunch break.So yea.

A quote from the working time directive part on direct.gov says quite correctly "If you are an adult worker (that is, over 18), you will normally have the right to a 20 minute rest break if you are expected to work for more than six hours at a stretch. A lunch or coffee break can count as your rest break. Additional breaks might be given by your contract of employment. There is no statutory right to 'smoking breaks'. The requirements are: the break must be in one block it cannot be taken off one end of the working day - it must be somewhere in the middle you are allowed to spend it away from the place on your employer's premises where you work your employer can say when the break must be taken, as long as it meets these conditions"

Contrary to what some of the uninformed may say/post, United States Department of Labor laws DO NOT REQUIRE an employer to provide you with any type of break time after you reach the age of 18 (before which you fall under "child labor laws" which DO require specified breaks/meal periods). That being said, any employer would be wise to provide their employees SOME kind of break time/meal period simply from the standpoint of maintaining employee morale, concentration, and productivity. Again, to answer your question, NO...the employer doesn't have to allow any breaks unless a local union agreement, etc stipulates as such.

No, unless your state has other rules or the job itself falls under other guidelines (e.g. DOT). Once you are 18, regardless of length of shift, employers are only required to give you reasonable access to a bathroom.

Yes, 30 min lunch & 2 10-15 min breaks. If she is not relieved she should say something. Everyone needs a toilet/smoke break.

I work12 hours from 6 til 6...I don't get an official break - I have to rush out to the kitchen to make a cup of tea and always eat and drink at my desk These are the sort of poeple I work for though...they dont give a damn. If she did, it was her choice. They can't force you to not have a break.

She should have a 20 minute break after any 6 hour shift.
