if a mother goes drunk driving with a 13 year old in the car and is stopped by a police officer .. the mother would get in trouble. but would the 13 year old also? because at 13 you are able to make a decision whether to get into the car or not with there drunken mother... so would the 13 year old be charged too? or no because they are technically still a young teen..?

Whose car is it? It is against the law, at any age, to allow a drunk person to drive a car (whether or not you are in it). However, if the teenager did not allow her mother to drive, and is merely a passenger, then I do not see the problem.
Of course, if the mother crashes and the teenagers dies, then she cannot become a police officer. To become a police officer, she has to stay alive. To stay alive, she has to stay out of the car.
Her age and whether it was voluntary do not matter; if she dies, at any age, for any reason, then she loses the ability to become a police officer. |

The mother will have to face DWI and possible she would be charged with endangering the welfare of a child. She just may end up losing custody of her child. Very dumb mom. |

It all depends on how drunk your mother is, if she isn't that drunk she is going to get in any trouble. You should just do what she says, maybe she'll let the 13 year old drink with her, that would be nice of her. |

Since the young lady wants to be enforcement she should understand that unless a law is against it, it is legal. There are lots of laws against adults to drink and drive -- but that drunk is his/her own problem and not the problem of any other person. The minor can be with the car, but the only laws would be against the adult -- for drunk driving *and* for risking the minor. |

The girl wouldn't get in trouble ... but the 13 year old however should never again get in a car with a drunk driver because it would be a recipe for disaster ... the crash risk is sooo much higher with a drunk driver .. especially like the one you described
and since it was a family party ... she should have asked to stay over that night or something.. maybe next time try to call someone ... check the bus schedule ... anything but get in the car
and to keep the mom safe too ... next time she should just take the keys away and hide them somewhere or something !! they really but their lives at risk |
