my car got written off and i was told i wasnt entitled to a courtesy car, that was about the 14th december 2010, then today (4th january 2011), my insurance company told me i am entitled to a courtesy car as im fully comp. So basically im really annoyed that over christmas i have spent over £150 on taxis when all along i could of had a courtesy car. Am i entitled to any form of compensation as i have been paying fully comp insurance which entitles me to a courtesy car but got told i wasnt??

Even a courtesy car isn't included in full coverage insurance a rental or courtesy car as a separate add which you pay extra for on your policy.

I don't know about where you live, but if you have rental coverage, they owe for a rental car till your car is repaired or when they settle with you for the totaled car. Rental coverage is usually a max per day and max they will pay on your policy. As an example, could have $30 per day for 30 days or a maximum of $900 they can pay. Now this is based on US coverage and sounds like you are in the UK, so don't know if they call their coverage courtesy coverage vs rental. But when you open a claim with YOUR insurance company, the 1st thing they do is verify what coverage you have on your policy. If this courtesy/rental coverage is on your policy and they failed to tell you this or told you, that you did not and now just found out, the adjuster is an idiot. Many policies even if you do not use a rental, will pay you personally in lieu of using a rental. So even if your policy pays $30 per day as an example, they may pay you $10 per day instead since it saves them money if you can find/borrow someone elses car in lieu of renting one. I cant tell you that they will pay back all that you state you paid, but they should pay you something, since it would be reasonable if your car is totaled and if you could not drive it, you would need to find a way to get to work, go to the grocery store etc. good luck

Yes. Turn in your receipts for taxi fares during that period for a refund.

Firstly, who initially told you that you weren't entitled to a courtesy car? If it was your insurance company, then it is their error and they should reimburse you for your taxi fares. They would have had to pay for the courtesy car in any case, so they won't be out of pocket by reimbursing you. I would say that you are entitled to compensation as you have paid out £150. The insurance company may deduct the cost you would have paid out in petrol for the taxi trips you made, but this would be knit-picking on their side. Hope this helps. Martin
