Wet Reckless VS. DUI Convictions in California?

I was arrested for a DUI by the CHP. I feel it was a very shadey situation. I believe my rights were violated. I had had 3 drinks in 3 hours. (I am a woman 115 pounds). Wasn't drunk. I hired a lawyer to fight the entire thing. 8 months later with continuance after continuance, this is where the situation is. The prosecution refused to negotiate anything. We set it for trial hoping they'd see I won't back down. Less than a week before, we got word their "star witness" (the arresting officer) would not be in town, therefore unable to attend trial. After much back and forth they decided to offer me a "Wet Reckless."The research I have done states that a "WR" is just as bad and carries the same penalties as a DUI. I have moved and become a resident of another state. I served my Liscence suspension, and now have a valid liscence in my new state. Will I serve jail time? Will my fines be upwards of $1000? Am I considered a criminal? Can I plea down further to a civil infraction?

Will I serve jail time? NO Will my fines be upwards of $1000? FINES ALONE, NO. BUT WITH CLASSES AND INSURANCE INCREASES, YOU WILL PAY MORE THAN 1K Am I considered a criminal? YES, A WET RECKLESS IS A MISDEMEANOR. BUT YOU ARE ELIGIBLE FOR EXPUNGEMENT Can I plea down further to a civil infraction? IF THE DA AGREES TO IT.

You should not have been driving to begin with. 115 lbs woman 3 drinks in 3 hours is intoxicated maybe not drunk, but that doesn't matter now. If your lawyer asked for the continuances he was an idiot. If your lawyer knew the CHP officer would not be available for trial that is inexcusable. You should have had the trial without the officer. Without the officer the prosecution would not have a case, evidence rules. The judge would have dropped all charges. The fines are almost the same as a DUI closer to $2000- 3000 if you consider all costs. Yes, you will have a record. You can plea to a lower infraction if the DA wants to, but why would the DA do it now? You had a bad lawyer

Go to court! Stand up for your rights, be brave! DUIs are bad, WR is looked at as the same. You sound that it makes no differance and you got a jury to decide not the over "worked" prosecutor. Pay the money to your lawyer or the fine, the only people that win in court are the lawyers. Good luck and don't drink and drive!
