What evidence is needed to prove theft?

Lets say something of yours was stolen and the police found the item but not at that persons house, when the police found the item, the person who had it gave them a name of who "actually" stole it.

one way is to keep track of serial numbers on the items that were taken. if you have the serial numbers and enough proof to have probable cause to search for that property and they have it then you can get it back.

How the police act in this case depends entirely on what and who they believe at the time the stolen item is found. They have quite a number of options. The police most likely will not automatically accept the story of the person in possession of the stolen item. If they believe that they have reason not to believe the person's story, they can arrest that person and get a search warrant to look for any more stolen goods on the premises. Even if they don't find any more stolen goods there, they can still charge the possessor with "receiving stolen goods," which is a felony. If they do believe the story, they can investigate the original possessor for evidence that he or she actually committed the theft. If they find that evidence, they can still arrest and prosecute both persons on different charges.. If they don't find that evidence, they can still charge the possessor, because simply being in possession of stolen goods is often considered to be "prima facie" (Latin for "on the face of it ") evidence of guilt by the police, the District Attorney, and the courts. "Evidence" could be other stolen goods from the same theft, fingerprints, witnesses, confessions, etc. (Police don't do DNA in simple theft cases; it's too expensive.)

It's difficult to prove the actual theft. If the item was reported stolen at the time then the person would be guilty of possessing stolen property. And it seems by his own admission he knew it was stolen regardless if he stole it or not.
