What happens when you get arrested?

I'm pretty clueless when it comes to this but I was just wondering what actually happens (the stages I guess) between getting arrested , going to court and perhaps going to prison. Say if you commit a fairly minor crime but you have a long record (the judge says you will go to prison if you commit another crime), what are the stages that you will go through? I was thinking that maybe a few days after you were arrested you go to court so they can set a future court date...is that right? Also, how many weeks/months approximately is it between getting arrested and going to prison?

Like all things legal in the US it depends on where you are. Different states have different laws. Different counties have different procedures. Different towns, usually by their size, have to deal with things differently. Step by step for a minor (misdemeanor) crime non domestic related, in my large city. You get arrested and taken to the local station. There the arresting officer asks you a lot of questions and writes the arrest report. If the arrest is approved by a sergeant and a watch commander you are taken to and processed in the lockup. You are fingerprinted, photoed and placed in a cell. A check of your prints and any wants nationwide is made. When your prints clear, meaning no one wants you, you can post bond. In my state the bonds for misdemeanors are preset and you only have to post 10% (no bondsmen are allowed in my state). Most misdos are $1000. so you need to come up with $100. In my city if you cannot come up with the money and your record shows that you show up to court and you have no pending court you are given a signature bond (no money just you promise). (weapons offenses must have a cash bond, misdo domestic violence always gets no bond and sent to the judge) When you bond you are given a court date. Not less then 2 weeks away and usually not more than a month. It goes by the arresting officers court key. They have misdemeanor court scheduled once a month. If you are not bonding for whatever reason you get turned over to the county sheriff and sent on a prisoner bus to court the next morning. You see a judge. In most cases he orders a signature bond since the county jail is over crowded. If they hold you in jail you are taken to court on your scheduled court date. The judge will consider your record for bond purposes. Only after you are convicted at trail will a judge consider you record for sentencing. Very few misdo convictions get actual jail time in my county. For a felony you always see a judge the next AM after arrest for a hearing. The judge will decide if there was really enough to arrest you and a gives you a bond hearing. If you cannot make bond on a felony you stay in jail until court. In most cases at least 3 months. In my area you have to have a bad record or have committed a really bad crime to go to prison upon conviction. In most cases you are given probation and a fine. If you spent time in jail that time is taken off any prison sentence.

It depends on the crime. The court dates are usually about a month apart (at least mine were). Sometimes the person will be held in the county jail until their hearing otherwise they will be out on bail. Usually there is a preliminary hearing, an arraignment and a trial. Once someone is sentenced they usually start serving their sentence immediately (although, I was allowed to start serving mine a month later). There is not always a direct course that each case follows. Every case is different.

When you get arrested, you are taken to jail. You get a phone call and can call a bailbondsman. You wait in the holding cell. If no one gets you out, then you get a jail uniform and go to the jail's general population. They separate misdemeanor people from felons. Within a few days, you will see a judge and make sure bail is set and the charges are legitimate. You will go back to court every 2 to 3 weeks (or month or two) until it is settled. Sometimes, it is settled after one time, but sometimes people wait months or years before they go to trial. If it is a simple case, you would probably plead guilty and get timed served, a fine, and probation. If it is not so simple, it is about six months more or less of useless court sessions until the trial. The jail has van fulls of prisoners going to court every day. Been there, done that.
