It would depend on the state.. Im law enforcement in NC and the NC General statue states that no you donnot have to buckle anyone in your custody,,But it is a good idea given the fact that anything can happen.. |

Yes, officers are supposed to place a safety belt on all prisoners while they are being transported. Now with that said a lot of suspects are able to unbuckle themselves if they do that its game on. that's why officers love to armoral their back seat so if they try to do anything all they have to do is slam on their breaks or make a sharp turn and then they just buckle them back up and start all over. |

Yes as not doing so could lead to liability for the police department in the event of a crash and once in custody you have certain due process rights(and the officer is responsible for your safety). However if there's some medical reason that the person can't wear a seatbelt then obviously that's an exception. |
