it was definetly a speed trap, going down the 73 toll road heading to San Diego to see my father, I was in the Air Force active duty at the time. Have to show up to court, Why? should I get a lawyer?

Speed trap, that's funny. By speed trap, do you mean that the officer was sittingon the side of the road and you went by 30 mph over the limit? I travel those toll roads alot and know that the cops sit at the bottom of hills, but that's not a speed trap. Active duty makes no difference. You don't have to go to court unless you want to contest the ticket. If you don't want to , just pay the fine and it's over with. You don't even need to see a judge to get traffic school or set up payments.

It would have been helpful if you had listed the actual statute you were cited for, but if it was 22349(a) VC, the fine as listed in the 2007 Uniform Bail Schedule is $380. That may vary slightly in Orange County, but it won't be by much. Before you go telling the world that you were caught in a speed trap, you should educate yourself on what the law considers to be a speed trap. Go here: http://www.leginfo.ca.gov/calaw.html And read section 40802 of the Vehicle Code. People often confuse getting caught while speeding with being stopped as the result of a speed trap (which is really pretty specifically defined). I'd be willing to bet you were caught by good ol' fashioned police work, and not because of a speed trap.

You have to show up in court? You don't have the option to pay before your court date if you want to? There should be a phone number on the ticket to inquire about this. The fine will be high at almost 30 miles over. But, if it is your first offense they may reduce the fine at court. Just go and ask for some type of reduction or if you can attend a defensive driving course to get it reduced and off you record. I don't think you need a lawyer for a speeding ticket.

The fine depends on the location of the violation, the speed at which you were traveling, and your driving record. You signed a promise to appear when you received the citation, you have to go to court to have a hearing with the judge, the officer who issued the citation will also be present. Most people don't retain defense attorneys for traffic court, as attorney's fees will cost more than the citation. I would *guess* you're going to be out a shade over $350.
