A no contact order and plea day?

My fiance has a no contact order on him that the police has put on him..not me. Anyways its a long story, you can read my other questions if you would like to know why. Ok so he plea date is in 10 days and I was wondering if he will be aloud to come home that day or have to wait until after that when he goes to court again? I wrote a letter to the crown attorney asking for the no contact order to be removed so will that help his chances of coming home? Thank you. I am going to he plea day and I am telling the judge also.

Unfortunately it is not possible to read you past posts so I will go with what I am assuming happened. Somehow your honey has been charged with an assault on you. If you live in Ontario you will not be able to drop the charge or the no contact order. It is part of the Domestic Violence Initiative. What was happening was that women did not want to press charges when their significant others assaulted them even though the police were called (by them or someone else) and the police were not pressing charges and women were dying. The justice system decided to automatically lay a charge in any domestic violence incident and to make a no contact order mandatory. The Crown will not drop the charge. The judge will not drop the order. It is all in your honey's court. He can a) plead guilty, and take his punishment which almost always includes some type of counseling now see you when all is said and done. b) plead not guilty and get found not guilty - then he can see you immediately. c) plead not guilty be found guilty do his punishment and at the end of it see you again. Honestly there is little or no wiggle room.

You should appear at the hearing and inform the court you wish the no contact order removed... this way the court can be sure that it what you want.
