Can a neighbor be prosecuted for giving permission to hunt on your property to others ?

A neighbor gave two of his friends, permission to hunt on my property. I got pictures of them on my game camera. The game warden found them, and they said that my neighbor gave them permission to hunt on the property, and gave sworn affidavits to back it up. Can my neighbor be prosecuted under Texas Law ?

To be considered trespassing you must give "notice" to the person. Notice means: 1 oral or written communication 2 fencing or other enclosure 3 sign 4 purple paint on trees or posts 5 crops for human consumption If the people did not know they where trespassing because none of the 5 above, then they where not trespassing. I know of no law that makes your neighbor criminally responsible. Make sure you at least paint your trees and post signs. http://www.statutes.legis.state.tx.us/Docs/PE/htm/PE.30.htm#30.05

Yes in Texas you need to see an attorney first.

What criminal code do you think the neighbor violated? You could potentially file a CIVIL action against your neighbor for the trespass - especially if the hunters actually took any game off of your property. But this does not sound like a criminal matter.

perhaps for something like aiding and abetting trespassing, or some obscure statute or ordinance. Nothing obvious comes to mind.

yes they could your neighbor can't give anyone permission to hunt on your property... if they was to get hurt they could sue you you could have them arrested for tresspasing and poaching on your property but that would be up to the game warden

More than likely yes, but you could probably call the police dept. (not 911) and ask them.
