According to my bank a check is no good after 90 days. I bought an item about 60 days ago and the person never cashed the check. I have sent e-mails and left voice mails requesting the person to cash the check, asking if they even received the check and no response what so ever. I saved all my emails. Can this person come back say after 90 days for payment? Is there a time frame were they can't get payment due to being irresponsible? I would like to use the money for something else if they are not going to cash the check and I can't force them to cash it nor am I. Not my job to babysit them. So what can I expect legally after 90 days?
There was no contract for item. I don't want item for nothing it just angers me that they are not being responsible. I do have money in my account for check to clear but I not going to leave it there for the rest of my life. Yes if they cashed it the funds would be gone, but if there is a time frame that is considered unreasonable and they are not allowed funds then it would be nice to know. I would think as a consumer I have rights too but that might not be so and that's what I am trying to figure out.

They can legally demand payment after the 90 days is up on the check you issued which would make it legally void. That they haven't cashed the check doesn't alleviate the fact you owe them money. So you would still have to pay them, however, you would only owe them the original amount and not any interest that money may have accrued sitting in your account.
Not certain what the time limit is on when they can no longer demand payment from you. Probably around seven years or so, though. Most things have that limitation attached to them. But what do you care? That money was supposedly spent, so if they had cashed the check already then you wouldn't have it. That is how you should be viewing the situation. Sounds like you want the item for nothing. |

Totally depends on the terms and conditions you agreed by signing when you bought the item. They have the right to ask you for another check or cash payment if the check proves invalid either by your fault or theirs in most cases. |

It's not true that a check becomes invalid after 90 days. You would have to place a Stop on the check to avoid it being cashed after that point. The other person can technically come after you for the unpaid amount. |
