I am no longer together with my ex and the IRS sent a check to him in both of our names. Can he cash the check wihtout me being present or having my id?

If he is your ex then why are you guys filing together? You could have filed seperatly. Since he received the check then he can't cash it legally by signing your name and you can't cash it by signing his name. Just go to the bank together. If you look on the back of those checks it will tell you it is unlawful to sign someone elses name. Don't do anything illegal especially with the IRS. |

No. He may be able to deposit it into an account, but as long as both names are on it, he cannot cash it without you there! If you think he is not going to give you your share, I would have a police officer present at the time of the cashing so that he can make the ex give you your share! Good Luck!

If the check is made out to Mr. Smith OR Mrs. Smith, you only need one person to sign it and show ID. If it is made out to Mr. AND Mrs. Smith , both parties need to show their IDs and sign in order to cash it.
Although I have heard of many instances where one party will forge the other's signature and write down their ID/DL # and deposit it in their bank account by ATM. That seems to be working for them. |

he can fake your signature on the back of the check, and most banks will take it. they aren't supposed to, but they just don't check that sort of thing much now. |
