Do I still have to pay child support if my only income is SSI?

My co attny says I need a letter from my Dr stating that I am totally and permanently dissabled and my Dr doesn't do any disability paperwork. I was reading on a ky law website that if SSI is your only income then the courts may order cs but cannot enforce it because ssi is for ppl in the poverty range who cannot work because of a disability. I live in Ky and I am so confused. I went to court on this and the co attny told the judge he didn't know what to do because I am at poverty level and the judge looked at him and said "well, you are the co attny so it's whatever you suggest." Anyway he said we'll set it at the lowest amount and if it doesn't get paid then we'll issue a bench warrant. Does anyone have the correct ansr to this? Pls dont tell me to find another dr cus none of them around here would write a letter like that and pls no questions about my disability. I Just need to know if I am obligated to pay. One more thing. My daughter stays with me three to 4 nights a week and the other 3 to 4 nights she stays with her aunt instead of her parent. All u all are wrong. I do want pay cs but my child is with me alot and not because the courts ordered it but because her mother is never home. We do have joint custody but she was granted primary. Yes SSA has to pay scs but I am on SSI and therefore am at the pverty level. There is a diffenece is SSI and SSA and DISABILITY. Look it up before you try to give me advice. Yes, you will still be required to pay child support. Even if you did get that doctor's letter. The point of child support is to make sure that parents pay for the support of their children & not the state. "Congress created the Child Support Enforcement (CSE) program in 1975 as an attempt to reduce public expenditures on welfare by obtaining support from noncustodial parents to keep custodial parents and their children off welfare." / http://www.ssa.gov/policy/docs/policybriefs/pb2004-02.html Your SSI may not be included when calculating your support payments. Even if it's not counted, the minimum rule is usually based on what you COULD make if employed full time at minimum wage. (Whether you are actually working or not.) So none of your proofs or lack of proofs really matter. What does matter is that the judge will know that your only source of income in SSI. And basically, all this says is that you are unable to pay & may give you leniency as far as jail time goes when you are brought before the court on that bench warrent for failure to pay. Because the judge knows that your child will still have no income AND providing for you in jail is another burden to the tax payers. But since they really want parents to pay for their children, you have got to know that your life style will be watched & any moment of it could be captured on phone cameras. And if any part of that looks like you have extra money then you can say goodbye to any leniency when brought back before the judge. That means no eating out at fast food restaurants when buying groceries is cheaper b/c these are sacrifices that parents make for their children when the family is not divided by divorce & it's added financial strains. "The statute of limitations for enforcement of child support arrears in Kentucky 15 years after the last child on the order emancipates." / http://www.supportcollectors.com/resources_kentucky.php#arrears_limit / This means that your child support obligations end when your youngest child turns 33 or 34 IF they have not brought suit against you during that time frame that would extend that dead-line. That's b/c even though you are on SSI now, doesn't mean you might not win a lottery anytime later. Or if you were killed in an auto wreck where the other driver was at fault, then the remainder of your child support payments would be a claim your child could make. So you are stuck with this for quite some time. Keep records of your income & payments & as long as you are showing maximum effort to contribute, then the judge should be willing to work with you & give you some breaks along the way.

Over half the people on disability do not need to be on it. And most of them are not totally disabled. I would be curious as to what ailment is making you "disabled"? Yes, you still have to pay child support. You brought the kid into the world and you need to pay for it. Not the tax payers. And drawing disability does not mean you are living in the poverty range. I know a guy who is drawing disability (and there is nothing wrong with him other than he is lazy) and they just bought a house and 2 new cars. Sounds like a pretty good living to me. I know people who work full time and cannot afford that.

If you have joint custody, why dont you file a child support order on her. It would be a wash since you both have custody.
