I need to write a complaint letter about my neighbor?

So I'm writing a complaint about my neighbor because he wrote a complaint to my landlord that he has smelt cigarettes, marijuana and incense burning from my apartment and saying "we party" and "disturb them in their sleep". I would respect these allegations if they were true! We don't smoke in our house, in fact, we only smoke when drinking. We do not smoke marijuana in our house either. The only true statement is that we burn incense... which to me seems a little unreasonable complaining about incense? And even if they did bother them, then they should be courteous enough to tell us to our face. Also in reference to the "partying" complaints, this is outrageous, because we NEVER have parties. We have had 3 gatherings of friends of a maximum of 10 people over the last year and all of which started in the day time, and ended at the LATEST 1am. Our gatherings conclude of dinner, card games, and playing of the guitar or low to medium sound on the stereo. Again, NOTHING offensive. Also I even recall one night getting huge stomp on the floor and it was a Friday night at 10pm! I KNOW my tenants rights are I can make noise until 11pm, so the fact they hammered on the floor at 10 was just uncalled for. We even went upstairs and knocked on the door and they wouldn't answer. All we wanted to do was clear the air of their issues and come to an understanding! Not to mention, the man who complains is INCREDIBLY rude, we've seen him outside and naturally we try to be a nice as possible because we are not looking for trouble, and all he does is glare and ignore us. I mean we are talking flat out ignorant. I've NEVER met someone this rude before in my life. Not only that, but my Landlord is writing a complaint also because not only has he complained about US, he has complained about the last 4 tenants in the suite as well. In other words...this guy has a problem with EVERYONE, meaning the problem isn't everyone, the problem is him. How do I go about writing this letter? How do I make my point strong enough? Thanks!

Personally after reading this question a couple of times, I have come to the opinion that you are a hemorrhoid, and we all know where they are a pain in. You seem to think that you can do just what you like and the rest of the apartment block has to put up with it. You could not be more wrong. Incense is great for those that like it when they are trying to cover up other smells, but to the rest of us it is an awful stink. I think you are either going to have to buy your own house or try to be a little more neighbourly. Oh and bye the way, I think the wacky baccy has gotten to your head, I will not say brain because that's up for discussion. They cant air their issues, but they can air their complaints, problems, subjects or even topics, but not issues.

Don't get upset - you need to be the one that the landlord sees as reasonable. Sounds like your neighbor is the local curmudgeon who keeps different hours and associates incense with people trying to mask the smell of marijuana use. I used to burn incense too but never smoked grass, but I realized that most everyone else who I knew who did smoke marijuana used the incense to try and obscure the smell. I gave up on incense when I discovered scented candles. More expensive, less messy and smells better and less like a headshop. It's up to you of course - I still love the smell of actual frankincense, and there is no candle that really replaces that. The tennant laws vary by area, and I don't even know what they are here, but I make sure the noise stops by 10:00pm. I just feel it's considerate of my neighbors, some of whom have little kids, or have to get up very early for a long commute. Sounds like your upstairs neighbor is fed up with other tenants' noise levels and has tossed out courtesy since he doesn't feel he's getting any either. I doubt he'll ever talk to you at this point, and clearly he seems to have a different view of local tennant laws. Get a copy of them, and refer to (quote) the relevant sections in your letter to your landlord. If the guy upstairs is just complaint-happy, I'm sure the landlord is aware of it. At all times, appear to be reasonable (no caps, calmly state the facts/times/dates) and it will just make the guy come off more as a grouchy kook. Advise the landlord that you attempted to discuss the matter with the guy upstairs, and he refused to to so, and what does the landlord suggest at this time. Some apartments are just not made well enough to cut off even modest smells and sounds from nearby units. Good luck with that.

You mean you cannot smoke in you own home in Canada? I think that is taking it a bit too far. I detest apartments. I would pretty much just tell it like it is and that his allegations were false and if they persist to either move you to another apartment or let you out of your lease. They may have had complaints from him before or he may be a bad tenant who is late with his rent or does not pay it at all. Neither of which holds much value in comparison to a good tenant.

write down all the points you think ar enecessary. try not to be biased explore the arguement from both sides. try to get proof or witnesses who would not seem biased to either side of the arguement
