If someone dies who is responsible for their debts?

My wifes ex husband (divorced 25 yrs) who has had nothing to do with his 2 kids, has 2 brothers a sister a step father, just died. Who is responsible for his debts if any? My step kids and his brothers have agreed to pay his funeral costs. He left no will. Thanks.

whether a person who dies leave no will. Then upon the dath certificate isw files by the funeral home, then the government trustee will look into looking after the deceased estate. If wx-husband had any assets the trustee will distribute his estate according to the laws of successtion and his estate will pay his debts.

Well what i have heard if a person dies and they have debt it depends if there spouses is alive or not..If there spouse is alive they are responsible but it the depends on if his name is on any of the debt....But if a family member dies and there name was the only on on that debt the creditors have to eat that cost...

If the guy died without a will, and either of his kids are living, they will be his sole heirs as a matter of law. Heirs have no responsibility for debts of a deceased individual, unless they are somehow personally connected to the debt (co-owners of a house, co-signor of a note, etc.) BUT...creditors pretty much get first crack at anything that's in the estate, so if the guy's debts are big in proportion to whatever he left, basically the heirs will get nothing. Exception: If his kids are minors, there will be certain allowances set aside for them before creditors can start taking their share...it doesn't matter whether or not the guy had anything to do with his kids.

His estate. If he has no assets the creditors will write off his debts. The kids don't have to pay for his funeral. Let his estate do that also. If he has no assets he can have a free pauper's funeral. Sounds like a fitting end.

Nobody ,, unless its the IRS ,, then they will Take what they want without asking ,, , and there isn't a court that will offer any Resistance , FEAR !!!

Ultimately the "family" would be responsible. More than likely his own 2 kids. His estate would go to probate since he didn't leave a will and then it would be dispersed accordingly. Contact an atty.

the person who lent the money. in my opinion. i mean he/she got screwed now that your wife's ex husband died.

their estate. They cannot come after any other person. If they has no assets, then the creditors are out of luck.
