Is it illegal to accuse someone of stealing without proof?

Yesterday at my work, I over heard my manager talking about how she thought one of the employees was stealing, but she didn't have any proof. She was talking to some of my co-workers about it, and when I asked what happened, they said they couldn't tell me anything because they could get in legal trouble. Why? What does that mean? But what did they mean by legal trouble? Great answer, Mike.

They are probably fearful that they could get in trouble for defamation (slander/libel). If you say something untrue about another person and it damages them in some legally recognizable way (for example, lost wages), then they may be able sue you for slander/libel. Specifics will depend upon the laws of the jurisdiction where the alleged slander occurred. However, in most, the operative fact is whether or not the statement is true or false--it does NOT depend upon whether or not the speaker BELIEVED it to be true unless that belief was reasonable.

The co-workers might not get in any "legal" trouble, but they could certainly lose their jobs if they repeat something that the manager told them not to repeat. If it bothers you, speak to the manager about it. Go directly to the source instead of repeating wild rumors. Maybe under the guise of wanting to help the manager watch the suspected thief.
