Is my FMLA over once my doctor releases me back to work?

I just gave birth to my daughter on 5/14/08. I went in for my 6 week check up and my doctor released me back to work on 6/25/08. Problem is my daycare provider backed out on me a week or so ago and everyone i have called doesnt have any openings until mid July. According to my work my FMLA would be up on July 25th 2008 but they said since my OB dr gave me a release back to work that It isnt FMLA anymore. Now they want me to request a leave of absence (which means my job isnt secure and they can deny it). I was under the impression I could take 12 weeks to care for my child ( i know my post partum was included in that). The FMLA website says: for the birth and care of the newborn child of the employee. So does my daughter have to be sick for it to be care under FMLA? I plan on calling the U.S. dept of Labor on Monday they were closed when I called today. Now I am worried I may get fired or my job isnt secure if they deny my leave of absence.

Your first run of FMLA ended when your doc released you to return to work. If you are having issues with childcare, you can file another FMLA notice to extend the care of the child.
