What can & can't bailiffs take? Are they allowed to seize goods that don't belong to the person owing monies?

Bailiffs arent allowed to take property of a person who isnt the debtor Also theyre not allowed to take food, clothing, bedding or any trade tools / things that you are required to have for work Bailiffs arent allowed to force entrance to the property unless they are enforcing a debt in respect of unpaid taxes, fines or child support, or evicting a person for whom an eviction notice has been issued by a court. For anything other than this they are only allowed to make what is termed 'peaceful entry' a legal grey area which some of them interpret as climbing over fences or through windows, or pushing past as a person opens the door. If you are faced with the prospect of a visit from the bailiffs the best advice I can offer you is do not open your door to anyone you dont know and if you hear a knock at the door from someone claiming to be the postman / gasman / etc then only open it on the chain, and dont leave any windows open

Bailiff's cannot take anything that does not belong to the person against whom they are enforcing a debt. If the debtor is part of a married or cohabiting couple they will assume that everything belongs to the debtor unless they can prove otherwise. If its a shared house then it would not be reasonable for them to assume everything belonged to the debtor, but the other flatmates should have their receipts handy. There are various other things that bailiffs cannot take, including tools of your trade, things obviously belonging to children and "necessities". Necessities are things essential for basic living - eg your bed, cooker, cutlery etc. However, this is fairly strictly applied, so a sofa, a microwave, or posh china would not be necessities. Once things are siezed the bailiffs have to hold them for at least a week before they dispose of them. If they have taken something wrongly (eg it belongs to someone else) you have at least this time to prove this and get it back.

They can only take goods belonging to the person who the order is against. The trick, if the accommodation is shared, is to label everything up in someone else's name.

they can take anything in the property as long as its not tools of your trade and basic living furniture table chairs bed ext and cooking utensils you will have to show documentation of other things that don't belong to you

i guess you're talking about UK bailiffs? if you are in a house with mates i don't believe they can touch anything that isn't yours. if you live in a house with a partner i think they can take both yours and his/hers items too. the only things i know they definitely don't touch is anything relating to children. always remember, you don't have to let them in! if you are having money problems and are being threatened with bailiffs, go to or phone your local citizens advice bureau. they have a specialist debt advice unit that can help, for free, and give advice on how to deal with your debt and what to do about bailiffs.

a court bailiff can't take any property. a bailiff job is to keep order/provide security in the court.
