What to do about nuisance parking?
|
A local business who rents out caravans, insists on parking one outside our old house (which is for sale) with for hire notices, becasue it's nearer the main road than his house. Two of the wheels are on the pavement.
When we asked us to move it he was insulting and laughed.
Surely this is antis-social behaviour, but the council won't act.
To clarify- it is a motor caravan, not a trailer caravan. We can't just tow it away.

It is a motor caravn. If it is taxed and insured then you really can't do diddly, he has as much right to park on the street as you do - just because it's outside your house it doesn't make it your space. Of course kids will be kids and tyres get slashed, bodywork keyed all the time doesn't it? |

It is an offence under the Road Traffic Act to park on a pavement as it's obstruction. Report it to the local Police. |

I had the same problem with someone using the road outside my house as his own personal car sales forecourt. For months there was one of his cars parked there with FOR SALE on it. Police and Council were no help. Then 1 night someone poured paint stripper over 1 of his cars. Wouldn't like to guess who did the dastardly deed but he never parked his cars there again. Sometimes there's just no other way. |

Your the property owner ... no problemo !
Contact a local Tow company and sign a contract with them to do the "Un-Authorized" towing from your property.
They post a sign and ...tow the nasty vehicles away.
The bigger the tow job .. the bigger the bill. if they have to used a Semi Cab Tow rig to remove the vehicle .. the recovery cost to the vehicle owner can be several hundred dollars.
Stick 'em where they live ..... in the wallet ! |

You can pop along to your local city council for advice. TWO WHEELS ON THE PAVEMENT???
No advice from the cll,,,well wonder why eh? Might be worthwhile doing a bit of background digging,
Have a chat with MR Plod who might know a bit. |

If the vehicle is parked in the street then you really have very little recourse. Technically streets are public and anybody can park in the street as long as the vehicles is parked legally.
At this point the only thing you can really do is either call the police or parking enforcement. If your community has an department such as Code Enforcement, and the vehicles have some of the wheels parked on the sidewalk, then that would be considered obstructing a public thoroughfare, and they could be cited, but other than that there isn't much you can do unless you want to file a civil suit against the other party. |

He is trading off a public road. It's illegal.
Phone the council back and ask to speak to the manager, and tell him this person is trading illegally [as it's for sale]then ask if the council if he has a trading licence to do so.
Make a note of whom you are speaking to date and time it then tell the manager what you have done and say you will take it further if you have to.Keep a note of EVERYTHING.
Good luck |

Like the other guy said, tow it. |

If he is legally parked then there is not many options but you can always call the police with a report of a suspicious vehicle parked outside your home. |

i deal with this issue often as enforcement officer for local council and the new "cleaner neighbourhood act" allows me to remove caravans from the highway as they should not be kept or stored on the public highway |

As long as he is legally parked there is nothing you can do.
I suggest the moment that van leaves parking your car there. |

Have it towed. |
