Find answers to your legal question.

can my at will employer refuse to give me a copy of a write up?

ok so heres the story, i was called into an office with my team leader and her boss, hr was not present, i was told that i cost the company money by not reading notes before shipping out of medical equiptment, i asked if i was the only employee getting in trouble for this since it goes threw 3 other peoples hands before it gets to mine, the lady stated we will take care of that and proceeded to tell me to the write up, i stated no i will not sign because if it was my first time making a mistake in the 7 months ive been here that i should get a verbal warning and not a write up, she stated well you cost the company money, i stated well the other employees should be in here to getting written up. she then stated ok since your not signing this form lets talk about your attendence record and that ive been out more than 5 times, (everytime im out of work i have medical notes due to me being a very sick person) i stated would i get in trouble even if i have medical notes she stated no but if your out again we will have some issues, and she wanted me to sign that attendence write up, i stated no, may i please have a copy to take it home and read over, she stated no since your not singing it im not giving you a copy, then she stated it was all run by hr but if it was then why wasnt hr there?? she began to belittle me stating oh have you ever worked at a company before, i said no, she stated oh well there you go, you dont know how companys work thats why your not signing, i stated well this is my first company, she then stated if im not going to sign to just go back to work, i got up and left to goto my seat. now does any of this sound illegal??? she refused to give me any copies of my records, should i talk to hr, if yes what should i say? i feel like ive been targeted by this lady since she got here. by the way this is a at will company, please help!

There are no laws that dictate how an employer can discipline its employees. The guidelines for that company are contained in the employee handbook, but nothing forces a company to follow its own rules. You have no recourse for their decisions other than internally, unless you have a contract (either with the employer or with a labor union), which has been violated. It is irrelevant (and none of your business) whether or not other employees have been disciplined for the same action. (And very unprofessional of you to bring it up.) Employees aren't generally given a copy of write-ups, which are internal documents only. BTW, this not the economy in which you wanna be contrary with the boss. There's a line outside for your job, with a lot of folks in it more than willing to be professional and compliant.

Your employer has no obligation to give you a copy of a disciplinary write up. That has nothing to do with the employer being "at will" since all employers in the US are "at will." (for the most part) If you have a concern that the disciplinary process is not being followed properly, you have every right and every reason to go to HR. You seem to be asking if you can be written up if you've never received a verbal warning. This depends on the company, but if the infraction is serious enough I imagine you can. HR can clarify the discipline process for you. You also ask if you can receive a write-up for calling out more than 5 times in the seven months you've worked there. This would be excessive in my book, and it seems like it's excessive to your supervisor as well. HR will clarify your company's attendance policy for you.

No universal law governs internal discipline for all employers.
