fired unjustly, what can I do?

I was fired from my job based on the false accusations of another person. What can I do? I was accused of misconduct in a correctional facility.

I am assuming you are in the UK (based on the fact that I am on Yahoo UK & Ireland) and my answer is based on that assumption. Basically, it depends whether you are employed on the basis of a contract (which doesn't need to be written) or on the basis of statute (as is the case with police officers - you may be included in this if you work in a prison) I'm not sure of the position for statutory employees, but for contractual employees you have a number of rights under the Employment Act 2008. If you were accused of an a breach of your employer's rules, you should have been invited to a disciplinary meeting and informed of your right to bring a companion to the hearing. If the employer subsequently decided to fire you, they should have informed you of your right to appeal against the decision. I think (and I stress that this is the opinion of a student) that you should be allowed to know who has made the allegations and to challenge the allegations. Basically I would suggest going to a specialist in employment law (try the citizens advice bureau if you can't afford a lawyer). Be aware, however, that legal fees alone can exceed £2000 for going to an employment tribunal and you are unlikely in the extreme to get costs paid by the other side. Best thing to do is threaten them with the ET, and hope they make a settlement offer!

You probably don't have recourse against your employer, since most jobs are on an at-will basis. Your recourse is against the person who made the false accusation. Just don't get caught.

Did you have a contract? Or was it employment at-will/for-cause? If you had a contract, you have some legal options. Otherwise, your employer can fire you for any reason (subject to a few limitations).
