Employment tribunal, how do i fill out a schedule of loss pro forma?
Find answers to your legal question.

Employment tribunal, how do i fill out a schedule of loss pro forma?

i have been sent a scedule of loss pro forma from the employment tribunal. it has 2 parts. part a - aparrently 'no need to fill this out as it follows a set procedure' part b - compensatory award. should be completed in discrimination cases. i dont have a discrimination case. i have an unfair dissmissal case. so it looks like i just leave the form blank? that dont seem right to me. can anyone help?

MEPHISTOPHELES
Part A on the form is your Immediate loss - i.e loss of pay, loss of pension contributions, and any other 'perks' (such as loss of company car) which are quantifiable (in monetary terms) from the effective date of dismissal down to the date of the Tribunal hearing. Part B - (Future Losses) are your continuing losses beyond the date of hearing. So (a) your continuing loss of (net) pay beyond the Tribunal hearing (The Tribunal will provide a guesstimate of the number of weeks you are likely to be unemployed given your job title and seniority and how long they estimate you are likely to be unemployed. - (b) Loss of Pension rights, (c) Loss of any other privileges/perks to your employment which are capable of being quantified in monetary terms. (d) Having arrived at a figure, the Tribunal are then obliged to deduct from that any Job-Seekers Allowance or other Social Security benefits you have received from the date of dismissal onwards. See: Norton Tool Co Ltd - v- Tewson [1972] ICR 501 NIRC. If you want more definitive advice - email me: geoff.chaplin@btinternet.com
