Please don't guess, I need a direct quote accompanied by a link to the laws. My coworker is doing this and I am getting fed up.
Well considering the boss smokes INSIDE, I don't think he would be much help.
Well we are not less than 5 people. More like 10.
I have a feeling you can't because what's stopping people from blowing smoke inside or the wind blows it inside? There are laws about smoking rooms that say the smoke cannot reach the other parts of the building. If wind blows smoke inside the building, then isn't that worse?

You are only going to find a link if it is banned (i.e., must smoke 5 feet or more). Lack of a link means that as long as the employee is outside, it is legal. Since none of the three CT Code sections prohibit smoking outside the door (only inside the door), there is no illegality. As for your boss, unless you are a very small company (less than 5 employees), he is prohibited from smoking inside also. |
