ten days agoIi had the tip of my right index finger bitten off by a dog, and because the piece I lost was so small, it couldn't be reattached, and to make things worse, to avoid infection and for functionality, I had to have the amputation revised down to the first joint:-( although I'd rather not sue the owner, since I've missed a lot of work and going to europe very soon, so losing a finger is the last thing I wanted, should I consider seeking damages for my unwanted amputation?

You should certainly get damages from his insurance, if he has insurance. If he doesn't, you should probably sue.
"amputee" is a pretty strong word for losing the tip of your finger though. But you definitely should be compensated. |

The only way you can recover for damages is to go after the owner of the dog period, be it by suing or by filing a claim with his homeowners insurance company. Suing is the last resort and usually if he has insurance, most likely will be awarded your medical costs/lost wages and pain/suffering.
But to collect, you will have to prove that you had no negligence at all by the dog biting off the fingertip. If you were playing with the dog and then the dog got overstimulated and subsequently bit your finger, could show that if not for your playing with the dog, this would have never happened.
You could talk to a lawyer about pursuing the owner of the dog for your damages to see if there is a case or not. I suspect that if you were to go to the owners, would state they do not have the money to pay you, so unless they file a claim with their insurance and/or you hire a lawyer, may get nothing. But then again, must show that you were in no way negligent in causing this injury.
