can my employer not allow me to smoke?
Find answers to your legal question.

can my employer not allow me to smoke?

I work 12.5 hour shifts with no breaks or lunch the company pay's 1 hour lunch penalties but said i can not step out the door on the premises and smoke can my employer do that?

Judy
Yes they can. It's their property, and they can make the rules. Since they're paying you for lunch, they don't have to let you leave the premises. And there are no federal laws requiring breaks or lunches, contrary to what another responder says. Some states, close to half, do have requirements, and there are usually requirements for breaks if you're under 18.

You cannot work that long with a break, against US labor laws. They can demand you not smoke on their property though.(If you step out for a quick smoke isn't that a break?)
