I need a divorce but no lawyer will stamp my papers........help!?

I have been seperated from husband since 2002. He skipped out of country and I have had no contact with him since 2006. We have a 6 year old son together. He contributes nothing at all. I live in the Toronto Area and need a lawyer to stamp my divorce papers as I feel I do not need to pay for his abondonment of myself and our son. I also would like to know if the justice of the peace can grant me the divorce free of chargre and how. He has never once paid a penny or shown interest to our son. I though we were in love, but upon my pregnancy he stated he married me only for Canadian Papers. We seperated right away. I need help........can't live knowing I am married to a looser. By the way, he was deported in Dec 04, came back to canada in Oct 05, immigration wanted to deport him again in Jan06. He is in hiding, Immigration cannot find him........I just need help......a good lawyer to help out. My budget if need be is $250.

When a child is involved, you can't just get a divorce. You must have a lawyer.
It isn't just a divorce you need, it's also child support. You cannot waive child support just because you want to. It isn't yours to waive. The courts must intervene for the sake of your son. No lawyer worth anything will sign those papers.
Contact your provincial branch of the Canadian Bar Association and ask for the telephone number for their lawyer referral service or pro bono network for help. If you do not qualify for aid, the price you pay the lawyer will be worth every penny you pay.
From the time your son was born to the age he reaches majority, the child support he receives (if put into RESP or investment savings account in the bank) will be enough to pay for his college education and maybe even enough for a downpayment on a home for himself. Don't give it away because you don't thing YOU need it! It is not YOURS to give away.
Even if the lawyer costs you a few thousand, it is money well spent for your son. |

Too bad you don't live in the USA so you could file "in pro per" (by yourself). Go for an annulment since you separated so soon after the marriage. |

Normally lawyers don't stamp legal documents.
I would take your papers to the court and have them do it for you, although I'm not that familiar with Canadian law. |

What is the reason a lawyer will not stamp your papers? Is it because you don't have the money or is it because of what's IN those papers? Usually, if they want a case, they'll work out a payment plan.
I'm just curious why they won't help you or refer you to legal aide or something more affordable. The only time I've ever seen people turn a case away is if it's going to tarnish THEIR reputation in any way. Or if the case is a sure loss to them, typically they don't want it.
