If he’s marrying just for her to get her papers, I hope he understands that he may need to stay with her for much longer than six months. I believe the new law is two years of physically living together before she can apply.
As far as what she needs to do:
If he marries outside of the US, she will need to remain in her country until she gets her green card. He will have to submit a petition for a visa form I-I30 to prove the marriage is real. She will be granted an immigrant visa within three to six months. Her stay will be conditional. If you married in the US, file the same form and then file I-485 to get a green card assuming she was not here illegally.

Marriage requirements are the same for all people. Immigration status has no bearing on your right to marry. As long as you are not currently married and are over 18 years old, you should be able to obtain a marriage license. If you are not in the United States and you want to come to marry an American, than you will need to apply for a fiancee visa. |

Are they in love or just marrying for her papers? If its just a business arrangement, she should pay your brother, for starters. Attorney fees are expensive, and I believe they have to legally be married for 2 years. They have to look like they are living together, ie: her name on bills, have some of her mail sent to the same address. I have known people who have done that. I think its ridiculous, but there is no way to enforce it. When the time comes to meet with attorneys and immigration, she better spend a week with him. Also take lots of pictures to make it look like they are married. I wish your brother luck. |

I am married to a Moroccan man and am bringing him to the US . Go to this website and it will tell you what paperwork you need to file to bring her to the US . It is faster if you are married before you try to bring them because there is no waiting list for Spouses to get a Visa .

There are lots of things it's not automatic.
He needs to marry her.
Have a job to support her.
She needs a medical.
She must have entered the country legally.
They must be able to prove that it's a genuine marriage.
The costs have gone up recently but its over $500.00 now to apply.
Either see an immigration lawyer or be very carefull with the paperwork it can be tricky.
I would strongly advise an immigration lawyer. |

Third, as long as it is a legal marriage, it is very simple to marry a person from another country. However, to marry an alien from another planet is more difficult, not impossible mind you, but getting the paper work straight is hard. |

Your brother will have to petition for her to become a permanent resident. It will cost around $1500 in filing fees (for ALL documents required) + medical exam cost, depending on her current status. It is a lot of paperwork. It can take 6 months to 2 years to process.
It is imperative that all paperwork is filled out completely and perfectly and that all required documents are attached. If your brother and his fiance are not very smart or if English is difficult for them, I suggest they hire a lawyer to help them. A lawyer will cost approx. $2500 in addition to the filing fees.
She does NOT already have to be here legally, although it does make the process run more smoothly if she is.
She does NOT need to prove that she can support herself, but your brother DOES have to prove that he can support her. There are minimum income guidelines for someone to petition for another person's residency. If your brother does not have a high enough income to support himself, her, and any children he/she/they have, the petition will be rejected.
The final step in this INITIAL filing process is a face to face interview with a review board. This is to confirm it is not a fraudulent marriage - to confirm your brother did not receive any type of incentive to marry her to get her papers and that she was not threatened or forced into the marriage.
There is no waiting period after they are married for him to petition. They can prepare all the paperwork prior to getting married then sign and file the day they get married if they want.
The only restriction regarding time, is that the residency is not considered a permanent status change until either 2 years after their filing date or 2 years of marriage (not sure which one). When this date comes around, there is another form which must be submitted in order to finalize her status. IF the form is not filed by the specified date, they have to start the process all over again. |
