Arachne	Perhaps like lots of people he likes to have some wine with his Christmas dinner and therefore he would not only be breaking the law he would be endangering your child's life,by driving afterwards.Could he not bring her home Boxing Day morning, then all will be well and there will be no problem. You could always have another "Christmas day" then.

Tony	Unless there is a contact order in place specifying that you will share the travelling involved in your ex having contact with your daughter, then it is his responsibility to pick up and return your daughter at the start and end of each contact period. If he is refusing to return her at the time specified in the contact order, then his contact period would be finished and he is breaking the order by not returning your daughter on the stated day/time. You should try and resolve this amicably with him, not always possible, I know from experience :) however he has to agree to return your daughter at the end of the contact period, if he does not then you need to make it clear to him that he will be breaking the order if he does not handover your daughter to you on the day in question. It is not your responsibility to collect her, however you may find it better to come to a compromise with him on this occasion.

Willa	If it's his weekend, it's his weekend. Most child custody orders have specifics regarding holiday times. If yours does not, then it's his weekend and that's it.

sheloves_dablues	It's his weekend. You can try and negotiate an early return, but he is not obligated to. And no, you cannot withold visitation on his weekend just because you have no way to pick her up. Christmas is three months away - you don't expect us to believe that in three months you can't figure out a way to have her picked up...

Amber	You can't break a court order because you don't have a way to pick your daughter up. You need to appeal to him to help you out with this. Rather than fighting, or yelling about it, honestly and calmly as him for your daughter's sake if he could bring her back, as you have no possible way to make it happen. If he refuses and wants to be difficult, then you just have to find a way. I am sure you have a relative, or someone close to you that has a vehicle. You have some time to sort this out, so hopefully he will help you out with this.
